Virtual staging rules across the US
Nationally, NAR's Code of Ethics Article 12 requires REALTORS to present a true picture in advertising and marketing, and Standard of Practice 12-10 extends that to internet content and images, barring manipulation of listing content that produces a misleading result and the use of misleading images. The Code does not name virtual staging or prescribe a label; the specific disclosure method is set by each MLS. Across MLSs reviewed, the common pattern is that staging is allowed if disclosed, via one or more of: a 'Virtually Staged' photo caption/description, a listing field or checkbox, a note in public (and sometimes private) remarks, or an on-image watermark.
Original photo: no national requirement found; varies by MLS. Some MLSs require the original photo next to the staged one (e.g., Canopy MLS, Metro MLS in Wisconsin), while others such as SmartMLS state an original is not required for staged photos. California state law (AB 723, effective Jan 1, 2026) requires a conspicuous statement on digitally altered listing images and access to the original, but applies only in California.
